These Terms of Service (“Terms”) govern your access to and use of the website at rara.jewelry and any related services, features, content, and online store (collectively, the “Services”), operated by RARA JEWELRY, INC. (Rara Jewelry,” “we,” “us,” or “our”). By accessing or using the Services, creating an account, or placing an order, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated by reference. If you do not agree, please do not use the Services.

1. Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, and able to form a legally binding contract to use the Services or place an order. By using the Services, you represent and warrant that you meet these requirements and that the information you provide is accurate and complete. Minors may use the Services only with the involvement and consent of a parent or legal guardian, who accepts responsibility for the minor's activity.

2. Accounts

You may need to create an account to access certain features. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You agree to provide accurate, current, and complete information and to keep it updated. Notify us immediately of any unauthorized use or security breach. We may suspend or terminate accounts that violate these Terms or that we reasonably believe are being used fraudulently.

3. Products, Descriptions, and Pricing

We strive to display our products and their details — including materials, gemstones, dimensions, and colors — as accurately as possible. However, we do not warrant that product descriptions, images, or other content are accurate, complete, reliable, current, or error-free. Because our jewelry is often handcrafted and natural gemstones vary, slight variations in color, finish, and appearance are normal and are not defects. Colors may also display differently on different screens.

All prices are listed in USA Dollars (USD) and are subject to change without notice. We reserve the right to correct any errors, inaccuracies, or omissions, and to change or update information (including pricing and availability) at any time without prior notice, even after you have submitted an order.

4. Orders and Acceptance

Your submission of an order constitutes an offer to purchase. All orders are subject to our acceptance. We may, in our sole discretion, accept, decline, or limit any order — including for reasons such as product availability, errors in pricing or product information, or suspected fraud. A confirmation email acknowledges receipt of your order; it does not constitute acceptance. A contract is formed only when we dispatch the product or otherwise confirm acceptance. We may cancel an order at any time before dispatch and will refund any amount charged for a cancelled order.

5. Payment

Payment is processed through our e-commerce platform (Shopify) and third-party payment processors. By providing payment information, you represent that you are authorized to use the payment method, and you authorize us and our processors to charge the total amount of your order, including taxes and shipping. You are responsible for any applicable taxes. We do not store full payment-card details; these are handled by our processors under their own terms and privacy policies.

6. Shipping and Delivery

We ship worldwide. Estimated delivery times for USA – 3-5 business days. Title and risk of loss pass to you upon delivery to you. For international orders, you are the importer of record and are responsible for any customs duties, taxes, and fees imposed by the destination country, and for compliance with its laws.

7. Returns, Refunds, and Exchanges

You may return eligible items within 7 (seven) days of delivery, provided they are unused, in original condition, and in their original packaging with any tags and documentation. The following items are non-returnable: final sale items, custom-designed or personalized pieces, engraved items, international orders, sale or promotional items, purchases made using store credit.

Because each piece is made to order, in case if you need a full refund for your order – your request must be submitted within twenty-four hours of delivery. To request a full refund, contact us contact@rara.jewelry 


Approved refunds are issued to the original payment method within 5 business days of our receiving and inspecting the returned item. This policy does not limit any non-waivable statutory rights you may have as a consumer (see Sections 15 and 16).

8. Intellectual Property

The Services and all content - including text, graphics, logos, images, product designs, and the “Rara Jewelry” name and marks - are owned by us or our licensors and are protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for personal, non-commercial purposes. You may not copy, reproduce, distribute, modify, create derivative works from, or commercially exploit any content without our prior written permission.

9. User Content

The Services may let you submit reviews, photos, or other content (“User Content”). You retain ownership of your User Content, but you grant us a worldwide, royalty-free, perpetual, irrevocable, non-exclusive, transferable, sublicensable license to use, reproduce, display, adapt, and distribute it in connection with the Services and our marketing. You represent that you own or have the rights to your User Content and that it does not infringe any third party's rights or violate any law. We may remove User Content at our discretion.

10. Prohibited Uses

You agree not to: (a) use the Services for any unlawful or fraudulent purpose; (b) infringe our or others' intellectual property or other rights; (c) upload viruses or malicious code; (d) attempt to gain unauthorized access to the Services or related systems; (e) scrape, data-mine, or use automated means to access the Services; (f) interfere with the proper operation of the Services; or (g) resell our products without authorization.

11. Third-Party Links and Services

The Services rely on and may link to third-party services and websites (for example, Shopify, payment processors, shipping carriers, and social media). We are not responsible for the content, policies, or practices of third parties. Your use of third-party services is governed by their own terms and privacy policies.

12. Disclaimers

Except as required by law, the Services and products are provided “as is” and “as available” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, secure, or error-free. Some jurisdictions do not allow the exclusion of certain warranties, so some of these exclusions may not apply to you.

13. Limitation of Liability

To the maximum extent permitted by law, in no event will Rara Jewelry or its officers, directors, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or related to your use of the Services. Our total liability for any claim arising out of or relating to the Services or these Terms will not exceed the amount you paid for the product. Nothing in these Terms limits liability that cannot be limited under applicable law, including liability for death or personal injury caused by negligence, for fraud, or for a consumer's non-waivable statutory rights.

14. Indemnification

You agree to indemnify and hold harmless Rara Jewelry and its affiliates from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of your breach of these Terms, your misuse of the Services, or your violation of any law or third-party right.

15. Governing Law and Dispute Resolution

These Terms, and any dispute arising out of or relating to them or the Services, are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-laws rules. Before filing any claim, you agree to first contact us at contact@rara.jewelry and attempt to resolve the dispute informally for at least 30 days. If the dispute is not resolved, it will be subject to the exclusive jurisdiction of the state and federal courts located in New York, and you consent to personal jurisdiction there. Any claim must be brought within one year after it arises, except where a longer period is required by law. This Section does not deprive consumers of the protection of the mandatory laws of their country of residence (see Section 16).

16. Consumers — Mandatory Local Rights

If you are a consumer, you benefit from any mandatory provisions of the law of the country in which you reside. Nothing in these Terms — including the governing-law and dispute-resolution provisions — affects your right to rely on those mandatory provisions. For consumers residing in Ukraine, the Ukrainian-language version of these Terms sets out additional rights under Ukrainian consumer-protection and e-commerce law, including the right to withdraw from a distance contract within 14 days, subject to exceptions provided by law (such as items made to your individual order).

17. Changes to These Terms

We may update these Terms from time to time. We will post the revised Terms on the Site and update the “Last updated” date. Material changes take effect upon posting. Your continued use of the Services after changes become effective constitutes acceptance of the revised Terms.

18. Termination

We may suspend or terminate your access to the Services at any time, with or without cause or notice, including for violation of these Terms. Upon termination, the provisions that by their nature should survive — including intellectual property, disclaimers, limitation of liability, indemnification, and governing law — will survive.

19. General

These Terms, together with our Privacy Policy and any order-specific terms, constitute the entire agreement between you and us regarding the Services. If any provision is found unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets. We are not liable for delays or failures caused by events beyond our reasonable control.
